JUST GOT SERVED PAPERS FROM CIVIL COURT! A GUY WHO PUT SOME COWS ON A 80 GRASS PATCH THAT JOINS US IS TAKING ME TO COURT BECAUSE MY BULL AND HIS GOT TO FIGHTING AND HIS HURT A LEG! TRYING TO SUE ME FOR THE COST OF HIS REGISTERED BULL!!!! HELLO AMERICA!!!!
SAYS HE IS OUT $2,400 BUCKS PLUS COURT COSTS!! SOMEBODY OUT THERE EVER HAD THIS HAPPEN TO THEM?

This comes as no surprise this day & age. Nothing personal against you, but look at the flip side, you would probably be suing him or seek some sort of compensation if his bull had broke your bull's leg.

I think the issues that would be important in a case like this are,
1. Where did the bulls fight? did your bull get onto his property or did his bull come onto your prpperty.
2. How did the bull get out? Whose fence was crossed.

Dan has the right questions and when it gets to the court house he who has the most paper to back it up wins. Sorry that this has happened but as long as the court system stays the same they can go after everybody.

Dan is correct on the importance of all his given factors. Here where I live it is a "fence-out" state. If you don't want my stock on your property, then they have to fence to keep them out. Of course, I don't play them game & I upkeep my fence to keep them in. I hate chasing them! I hope things work out for you Ricky.

This is where good liability ins. comes in!!! Hell I saw an add on TV the other day for people that have been in an accident, any kind, no matter who's fault, they had attorney wanting to defend them.:confused:

Dont feel real bad ,we have a nabor that does not want us to graze our own land,does not want our cattle to drink out of our 56 ac. lake,because his land joins our lake on the south side. what a neighbor
GOOD LUCK , IT WILL PROBABLY DEPEND ON THE JUDGE YOU GET. IF YOU DO HAPPEN TO LOOSE , I WOULD EXPECT TO TAKE HOME EITHER THE BULL OR THE BEEF FOR THAT MUCH MONEY.:D:D:D

It's nice to live in a state where you fence cattle and horses out / pigs and sheep in. Check you laws and see what they say.
Maybe counter sue him for his bull starting the fight, antagonizing your bull and turning him into a fighter that you'll have to deal with for the rest of his life :cool:

So you're telling me that you would not want any reimbursement if someone's bull was on your place & injured one of your bulls & IF that bull was your best one & worth a lot of money?? Don't get me wrong, I am FAR from sue-happy & have NEVER sued any body before, but IF I had a high dollar bull & I was not at fault in any way, I would more than likely be seeking some reimbursement of some kind. I don't know, maybe I am different than everybody else, but I can't afford to just crack out & buy another "high-dollar" bull & rub it off with the neighbor like it was no big deal.

Everyone is different but things happen. If you have animals around; things similar to the issue at hand happen. How many people have bulls of their own that cripple another?
It's hard to lose a good one and that's the purpose of raising animals. You have the factory (breeding program) and the success/failure doesn't rest on one animal.
I also believe that if you have them that you are going to lose a few. It's also part of the game. 100's of great bulls never are seen because they end up crippled.
We've lost many great over the yrs. but it happens. Every contractor has lost some great animals to various circumstances.

If you two shared a fence you may have some ground to stand on in that you both have a responsibility to maintain a barrier between to two heards , not sure if the free range will help you . I had a bull get out and wiggled his way into a pasture with a mans cows , all was good and he said i could fix the fence back for him , make a long story short ended up he would rather have someone else fix it and I bucked the price. Ended up costing me $926.00 and court cost for two fence post and a roll of wire that only about 50 ' was used .

A couple of years ago our neighbor put in 60 head of black angus cows right next to our pasture. I had my cows and a bull in my pasture. The neighbor had the 60 head of cows that were in heat in his pasture but no bull. The neighbors cows came to the fence and bawled and backed up to the fence and my bull went right over to take care of business. I had to bring him home 3 separate times. Of course the neighbor threw a complete fit that my big spotted bull with horns had bred his registered angus. He demanded that I work all 60 head of those cows. I ended up having to pay for 60 head of angus being preg checked and lutalysed.

If his bull is still able to breed cows then you shoulnt be liable for the full price of the bull.

This kind of reminds me of two bulls that hooked up a while back. Lets see. One maingy ol' sale barn bull {Justin Crawford},was taunting a line bred mexican fighting bull{Keith Nabours}. The "Mex" attacked and wounded ol' "Maingy". Who is liable??????
I'm not making light of the original post. That is very serious and disturbing. Just thought I'd liven' things up a bit!

This not directed to anyone, just something I thing is useful information regarding this subject.
A couple of years ago I got called up for jury duty. I was actually kind of excited to go.
I was juror 12 before they had the selection, so I was up there getting questioned to see if I would make a good candidate.
The case:
This guy's limo bull got out and a car hit him and killed him. The people driving the car were suing the rancher for distress! Totally BS to me. Plus the person they said was driving was not the one driving; it was the drunk guy with no license that said he was in the passenger seat (at least they told us that would come up and we would have to decide who we thought was driving).
The judge said time and time again that we could not judge by the statute that Colorado was a fence out state or free range. He said it was his courtroom and what he says goes no matter what the law says! We had to determine if we felt the rancher was negigilent (sp).
Needless to say when I explained what I do I was I was not called up for jury duty. I'm not sure how it played out, but fence out doesn't always protect you!
Moral of the story - be careful; some people will always find ways around the law to get paid.

Ricky, have had my bulls cross the fence a time or two to bred cows and to keep the peace I've always told the neighbor when they sold calves to save the ones they knew were out of my bull ( not hard running spotted bulls) and I'd give em the same price they got for they're "good cattle" usually pitch in another 40 bucks on top of that and they never compain again. Kinda think some of them want my bull out...get a better price than market and no commision.
Have had several bull fights with neighbors bull but never got one hurt. I know in Oklahoma bulls have right to roam and if one gets out and someone hits it you loose your bull and they loose the car. Nobody at fault and nobody can get sued. Now there is a contest to that if they can prove negligence on your part to keep fences up enough to keep the bull in. If he is always out and they can get the neighbors to testify to that then you gotta fix the car.
I'd sure get a good country lawyer and have a talk. Let us know how it turns out.

this open range law everyone talks about dosnt hold water in most court rooms,Texas is still under this OPEN RANGE law but you also have stipulations,you must have and maintain good fences,you must do all you possibly can to prevent your livestock from getting out,so dont count on the open range law saving your butt when your in the courtroom cause theres much more to it then that.I maintain a million dollar liability policy too with all my livestock and farm vehicles just in case i ever need it.

Whatever happened to good neighbors. Sheesh if you live next to others with livestock and have them yourself, you know the risks involved with them getting through fences etc. Sad someone feels they have to sue someone like whats happing to Ricky.
here is a good one. I used to pasture my bulls on snake river canyon where evil knevil made his canyon jump. the guy i leased the pasture from bought a long horn cross [3 yr. old] bull for his roping cows, he jumped in my side with the yearlings and well guess what happened after looking for him, we found him about 300 ft down in canyon [splat] my yearlings fought him and he lost. I offered to pay for him but he and his dad said they should of check the fence better and fix there share so needless to say all is well. Also the breeding bull i use now, sombody left a gate open on the pasture as a 2 yr old he took a walk about and two herefords bulls down the road kick his butt and broke a front shoulder or somthing i got him for a good price. When he was healthy the person i bought him from wanted 10,000 for him, he was a bucking sob.Once again neighbors still remain freinds after that deal, somtimes things just happen.
I would pray for those people to have understanding and things will turn to everyones favor.
